Terms of Use

Last updated:

These Terms of Use govern your use of the LoveMemo app for iOS and Android, the website at lovememo.app and the surprise pages created with the app (together, the “Service”). By downloading the app or using the Service, you agree to these terms. Please also read our Privacy Policy, which explains how we handle your data.

1. Who we are

LoveMemo is created and operated by Jonatã Oliveira, based in Brazil (“LoveMemo”, “we”). You can reach us at [email protected].

2. The Service

LoveMemo lets you create a romantic surprise, a web page with your photos, a song, a message and a counter of your time together, and share it through a private link or a QR code. The person who receives it opens it in the browser, without the app. The app also offers a free couple widget for the home screen.

You must be at least 13 years old (or the minimum age required in your country) to use the Service. If you are under 18, use it with the consent of a parent or guardian.

3. Your account

An account is created automatically when you start using the app, and you can optionally link it to Sign in with Apple or Google. You are responsible for activity on your account and for keeping your device secure. Tell us right away if you suspect unauthorized use.

4. Purchases

  • Downloading the app and using the couple widget are free.
  • Publishing a surprise is a one-time in-app purchase, sold through the App Store or Google Play. Before paying you choose how long it stays online (1, 2, 3, 6 or 12 months) and see the final price in your currency. There is no subscription and nothing renews automatically.
  • The period starts when the purchase is confirmed. When it ends the surprise stops being available; you can extend it in the app before or shortly after it expires.
  • Payments, billing and refunds are handled by Apple or Google under their own terms. To ask for a refund, use reportaproblem.apple.com or your Google Play order history. If something went wrong with a surprise, write to us and we will do our best to fix it.
  • Nothing in these terms limits the rights you have under mandatory consumer protection laws of your country.

5. Your content

The names, photos, message, song link and other content you add to a surprise are yours. To provide the Service you grant LoveMemo a worldwide, non-exclusive, royalty-free license to store, copy, process (for example, resize photos) and display that content to people who open the surprise, only for as long as needed to operate it. This license ends when the surprise is deleted.

You confirm that you have the right to use everything you add, including the consent of the people who appear in the photos, and that your content does not:

  • break any law, or infringe anyone’s copyright, image, privacy or other rights;
  • contain sexual content involving minors, sexual content without consent, or content that is violent, hateful, discriminatory or harassing;
  • impersonate someone or deceive the person receiving the surprise;
  • contain malware, spam or advertising.

We may remove content, or suspend a surprise or an account, that violates these terms or the law, or when required by a competent authority. If you think a surprise violates your rights, write to [email protected] with its link.

Surprises are not listed or indexed, but anyone who has the link or the QR code can open them. Share them with care. You can edit the text and the song, or delete the surprise, at any time in the app.

7. Music and third-party services

LoveMemo does not host songs. The song in a surprise is a YouTube video chosen by you and played by YouTube under its own terms; it may become unavailable if it is removed from YouTube. The Service also relies on the App Store, Google Play and other providers listed in the Privacy Policy, whose terms also apply to your use of them.

8. Acceptable use

Do not misuse the Service. In particular, do not try to access surprises or accounts that are not yours, interfere with or overload our systems, scrape or copy the Service at scale, reverse engineer the app beyond what the law allows, or use the Service to send spam or for any unlawful purpose.

9. Our intellectual property

The LoveMemo name, logo, app, website, presentation styles, designs and code belong to LoveMemo and are protected by law. These terms give you a personal, non-transferable right to use the Service; they do not give you any other right over our intellectual property.

10. Availability and changes to the Service

We work hard to keep LoveMemo available, but we cannot promise that it will be uninterrupted or free of errors. We may change, add or remove features. If we ever stop offering the Service, we will give reasonable notice and keep active surprises online for the period you paid for, or offer a proportional refund where the law requires it.

11. Liability

The Service is provided “as is”. To the extent permitted by law, LoveMemo is not liable for indirect damages, loss of data that you could have backed up, or problems caused by third-party services, your device or your internet connection. Nothing in these terms excludes liability that cannot be excluded under applicable law, including consumer protection law.

12. Ending your use

You can stop using LoveMemo and delete your account at any time in the app. We may suspend or close accounts that seriously or repeatedly break these terms.

13. Governing law

These terms are governed by the laws of Brazil. If you are a consumer, you keep the protection of the mandatory laws of the country where you live and may bring a claim in the courts of your place of residence.

14. Changes to these terms

We may update these terms. The date at the top shows the latest version. If a change significantly affects your rights, we will highlight it on this page before it takes effect; continuing to use the Service after that means you accept the new terms.
